Most UK employers are aware they need to apply for a license to sponsor any non European Economic Area migrants they want to bring into the UK. However, they may not be aware that applying for a sponsor license will trigger a UKBA compliance audit of their organisations. The compliance audit involves a complete dissection of their HR systems, record keeping and compliance with the immigration rules. Employers will also have to prove that they have undertaken the necessary checks before employing overseas staff.
What are the penalties for companies who are not compliant with their sponsorship duties?
Companies who are not compliant could face severe penalties, with fines of up to £10,000 per employee and up to two years' imprisonment.
